{"id":21151,"date":"2022-02-24T09:00:00","date_gmt":"2022-02-24T08:00:00","guid":{"rendered":"https:\/\/www.emagister.com\/blog\/?p=21151"},"modified":"2022-02-24T16:21:19","modified_gmt":"2022-02-24T15:21:19","slug":"te-ves-afectado-ere","status":"publish","type":"post","link":"https:\/\/www.emagister.com\/blog\/te-ves-afectado-ere\/","title":{"rendered":"Qu\u00e9 hacer si te ves afectado por un ERE"},"content":{"rendered":"\n<p>La palabra <strong>ERE<\/strong> (<span style=\"color: #ff0000;\">Expediente de Regulaci\u00f3n de Empleo<\/span>) era bastante desconocida en el vocabulario del espa\u00f1ol medio hasta que empez\u00f3 la <span style=\"color: #ff0000;\">crisis<\/span>. Sin embargo, en poco tiempo, el dichoso acr\u00f3nimo se hizo omnipresente en todos los medios. Desde entonces ha protagonizado muchos titulares, y todav\u00eda hoy sigue apareciendo regularmente en las noticias. Pero, <strong>\u00bfQu\u00e9 implica exactamente un ERE?<\/strong> Y lo que es m\u00e1s importante: <strong>\u00bfQu\u00e9 debes hacer si te ves afectado por un ERE?<\/strong><\/p>\n\n\n\n<p>El concepto de <strong>ERE<\/strong> est\u00e1 recogido en la legislaci\u00f3n espa\u00f1ola y es el procedimiento mediante el cual una empresa que atraviesa una mala situaci\u00f3n econ\u00f3mica pide autorizaci\u00f3n a la autoridad laboral competente para despedir trabajadores en un marco que se garanticen ciertos derechos laborales. Hay tres tipos de <strong>ERE<\/strong>: <span style=\"color: #0000ff;\">Extinci\u00f3n, Suspensi\u00f3n y Reducci\u00f3n<\/span>.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"text-align: justify;\">El <strong>ERE<\/strong> de <span style=\"color: #0000ff;\">Extinci\u00f3n<\/span> supone la finalizaci\u00f3n definitiva de la relaci\u00f3n laboral entre la empresa y el trabajador (grupo de trabajadores). Es lo que se conoce coloquialmente como \u201c<em>despido colectivo<\/em>\u201d, y es la tipolog\u00eda m\u00e1s desfavorable para el trabajador.<\/li><li style=\"text-align: justify;\">El <strong>ERE<\/strong> de <span style=\"color: #0000ff;\">Suspensi\u00f3n<\/span> consiste en establecer un nuevo calendario laboral a la plantilla o a una parte de ella. En el calendario se establece unos d\u00edas concretos en los que no habr\u00e1 actividad laboral. Hay diferentes grados, desde la empresa que decreta un d\u00eda a la semana de suspensi\u00f3n hasta la que pide varias semanas al a\u00f1o.<\/li><li style=\"text-align: justify;\">El <strong>ERE<\/strong> de <span style=\"color: #0000ff;\">Reducci\u00f3n<\/span> tambi\u00e9n establece un calendario laboral, pero en lugar de \u201c<em>mandar a los trabajadores a casa<\/em>\u201d en d\u00edas concretos se escoge reducir la jornada laboral en determinados d\u00edas. Es decir, el trabajador sigue yendo a trabajar los mismos d\u00edas pero en algunos de ellos trabaja menos horas.<\/li><\/ul>\n\n\n\n<p>Antiguamente las empresas que quer\u00edan solicitar un<strong> ERE<\/strong> de <span style=\"color: #0000ff;\">Extinci\u00f3n<\/span> deb\u00edan solicitar autorizaci\u00f3n administrativa, por tratarse de un caso excepcional. La reforma laboral , aprobada en un contexto de crisis, ha suprimido este requisito (la autorizaci\u00f3n administrativa previa) y la empresa puede tomar la iniciativa del <strong>ERE<\/strong> de manera unilateral. Eso no significa que el trabajador no pueda impugnar el <strong>ERE<\/strong>, pero deber\u00e1 hacerlo directamente en los tribunales.<\/p>\n\n\n\n<p>Para que haya un despido colectivo la empresa debe extinguir contratos de trabajo que afecten un m\u00ednimo de <strong>90 d\u00edas<\/strong> a: diez trabajadores, en las empresas que ocupen menos de cien trabajadores; el 10 por ciento del n\u00famero de trabajadores de la empresa que tengan entre cien y trescientos trabajadores; treinta trabajadores en las empresas que empleen a m\u00e1s de trescientos trabajadores.<\/p>\n\n\n\n<p>El <strong>ERE<\/strong> por causa econ\u00f3micas se da cuando la empresa sufre una situaci\u00f3n econ\u00f3mica negativa y una disminuci\u00f3n persistente (tres trimestres con peores datos que los tres del a\u00f1o anterior) del nivel de ingresos o ventas. En cuanto a las causas t\u00e9cnicas, estas se producen cuando var\u00edan los medios o los instrumentos de producci\u00f3n de la empresa. Las causas productivas e dan cuando hay cambios en la demanda de los productos o servicios que ofrece la empresa. Finalmente, las causas organizativas hacen referencia a los cambios en los sistemas y m\u00e9todos de trabajo del personal.<\/p>\n\n\n\n<p>Aunque hemos comentado anteriormente que la empresa no necesita pedir autorizaci\u00f3n previa a la autoridad laboral ni llegar a un acuerdo con los representantes de los trabajadores, eso no quita que los trabajadores afectados por un <strong>ERE<\/strong> no tengan derechos.<\/p>\n\n\n\n<div class=\"wp-block-image wp-image-21710 size-full\"><figure class=\"aligncenter\"><img loading=\"lazy\" decoding=\"async\" width=\"507\" height=\"338\" src=\"https:\/\/www.emagister.com\/blog\/wp-content\/uploads\/2015\/08\/ThinkstockPhotos-175211053.jpg\" alt=\"ERE\" class=\"wp-image-21710\" srcset=\"https:\/\/www.emagister.com\/blog\/wp-content\/uploads\/2015\/08\/ThinkstockPhotos-175211053.jpg 507w, https:\/\/www.emagister.com\/blog\/wp-content\/uploads\/2015\/08\/ThinkstockPhotos-175211053-245x163.jpg 245w, https:\/\/www.emagister.com\/blog\/wp-content\/uploads\/2015\/08\/ThinkstockPhotos-175211053-80x53.jpg 80w, https:\/\/www.emagister.com\/blog\/wp-content\/uploads\/2015\/08\/ThinkstockPhotos-175211053-462x308.jpg 462w, https:\/\/www.emagister.com\/blog\/wp-content\/uploads\/2015\/08\/ThinkstockPhotos-175211053-330x220.jpg 330w\" sizes=\"auto, (max-width: 507px) 100vw, 507px\" \/><figcaption><em><strong>ERE<\/strong> es el acr\u00f3nimo de <strong>Expediente de Regulaci\u00f3n de Empleo<\/strong>, una palabra que ha copado titulares en los \u00faltimos a\u00f1os<\/em><\/figcaption><\/figure><\/div>\n\n\n\n<p>Los derechos b\u00e1sicos que tienen los empleados afectados por un despido colectivo (<strong>ERE<\/strong>) son:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Solicitar una prestaci\u00f3n por desempleo (siempre cuando cumplan los requisitos de cotizaci\u00f3n suficiente). Leer m\u00e1s abajo los detalles<\/li><li>Percibir una indemnizaci\u00f3n por el despido (que ser\u00e1 de como m\u00ednimo de 20 d\u00edas por a\u00f1o trabajado, con un m\u00e1ximo de 12 mensualidades)<\/li><li>Participar en un plan de recolocaci\u00f3n<\/li><li>Impugnar judicialmente el despido (a trav\u00e9s de los representantes sindicales o a t\u00edtulo individual)<\/li><\/ul>\n\n\n\n<p>En el caso que te veas afectado por un <strong>ERE<\/strong> y quieras pedir la prestaci\u00f3n por desempleo, la cuant\u00eda se calcular\u00e1 en funci\u00f3n de las cotizaciones realizadas durante los periodos trabajados.
